Lawsuit to Block $1 Million Elon Musk Voter 'lottery' Moved to Federal Court

Elon Musk failed to show up to a required hearing in a Philadelphia case challenging his $1m-a-day sweepstakes.


His absence would have risked contempt of court had the case continued in Pennsylvania court, but it was moved to federal court in response to a motion filed by Musk’s attorneys, who did attend the hearing. No hearings were immediately scheduled in the federal case.


A Philadelphia judge ordered X CEO Elon Musk to appear in a hearing Thursday morning over his super PAC’s plan to award $1 million a day to voters in key battleground states. But Musk skipped his courthouse appointment after the same judge granted a request to transfer the case from Pennsylvania state to federal jurisdiction.

Musk's attorneys filed documents Wednesday night in the U.S. District Court in Philadelphia, a federal court, requesting the matter be moved to their jurisdiction – and out of the local Court of Common Pleas. A judge granted that transfer. But Krasner's attorneys contested that recommendation. 


Later Thursday, a federal judge ordered Musk's legal team to file a response to Krasner's request that the matter be sent back to state court. The order says it must be done by 10 a.m. on Friday. 


"We will proceed to federal court and we will address the issues there, and seek to have the matter remanded back to the state court. After all, this is a case that involves state law issues and I'll leave it at that,"

John Summers, an attorney for Krasner, said.

The legal showdown had the potential for fireworks as a judge ordered Musk to appear personally in a Philadelphia courtroom. Musk was a no-show, and a lawyer for his America political action committee filed a perfunctory “notice of removal” late Wednesday night to move the case to federal court.
